Terms of Use

These terms govern your use of the FocusAI website and products operated by FocusAI Limited (NZBN 9429053378026), trading as FocusAI. By using our websites or products, you agree to these terms. If you don’t agree, please don’t use them.

Individual products (StopBy, Pulze, SightDesk, OneThing) may have their own additional terms. Where they do, those apply alongside these terms.

01 Who we are

FocusAI is a New Zealand AI product studio based in Havelock North, Hawke’s Bay. We build apps and websites including StopBy, Pulze, SightDesk and OneThing, and undertake custom work for clients.

02 Using our services

• Use our products only for lawful purposes and in line with these terms.
• Don’t misuse, disrupt, reverse-engineer, or attempt to gain unauthorised access to our services or systems.
• You’re responsible for any account you create and for activity under it.

03 Subscriptions & payments

Some products offer paid plans. Where a product is distributed through the Apple App Store, purchases and subscriptions are handled by Apple (and processed via RevenueCat), subject to Apple’s terms. Pricing and what’s included are shown at the point of purchase.

04 Intellectual property

The FocusAI name, product names, branding, software, and content are owned by us or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable right to use our products as intended. You may not copy, resell, or create derivative works without our written permission.

05 Third-party and open data

Pulze is built on publicly available, open-licensed New Zealand government data (for example, data licensed under Creative Commons Attribution). That data remains subject to its original licence and attribution requirements. Our products may also link to or rely on third-party services we don’t control.

06 Important disclaimers

Pulze is information, not advice

Pulze provides economic and market information for general purposes only. It is not financial, investment, legal, or professional advice, and you should not rely on it as such. Always do your own due diligence and seek qualified advice before making decisions.

StopBy and safe use

StopBy provides reminders and notifications. Do not interact with your phone while driving. Always follow road rules and prioritise safety; FocusAI is not responsible for use of the app in a manner that is unsafe or unlawful.

07 Services provided “as is”

We work hard to keep our products reliable, but we provide them on an “as available” basis without warranties of any kind, to the extent permitted by law. Nothing in these terms limits rights you may have under the Consumer Guarantees Act 1993 or other NZ consumer law that cannot be excluded.

08 Limitation of liability

To the maximum extent permitted by law, FocusAI is not liable for indirect or consequential loss arising from your use of our products.

09 Suspension & termination

We may suspend or end access to our products if these terms are breached, or if we need to for legal, security, or operational reasons.

10 Governing law

These terms are governed by the laws of New Zealand, and the New Zealand courts have non-exclusive jurisdiction.

11 Changes

We may update these terms from time to time. We’ll update the date above, and continued use after changes means you accept the updated terms.
